  • ❌ Network congestion or blockchain delays

USER RESPONSIBILITY: You are solely responsible for:

WE ARE NOT RESPONSIBLE FOR: Funds sent to incorrect wallet addresses, funds sent on incorrect networks, delays caused by third-party platforms, or any losses incurred due to user error when using external services.

All content uploaders must verify their age and identity through our verification process. Failure to do so may result in account suspension or permanent ban. Verified accounts receive a verification badge on their profile.

You retain all rights to the content you upload. By uploading, you grant the Platform a license to host, display, and distribute your content as necessary to provide our services. You may delete your content at any time. Deleted content may remain in backups for up to 30 days.

6. Wallet System Wallet

💰 6.1 How the Wallet Works

The Platform uses a dual-wallet system for all financial transactions. Every user has two separate wallets:

  • Spending Wallet: Used for purchases (subscriptions, PPV content, escrow deposits). Funds in this wallet come from deposits (credit card or cryptocurrency) or transfers from Earnings Wallet.
  • Earnings Wallet: Used for creator earnings from content sales, subscription revenue share, referral commissions, and escrow payouts. Funds in this wallet can be withdrawn to bank, PayPal, or cryptocurrency.

  • Maximum deposit: $500.00
  • Deposit fee: 0%
  • Funds never expire and can be used for any Platform purchase
  • All deposits go directly to your Spending Wallet

🔄 6.3 Transfer Policy - NO REVERSE TRANSFERS AML Compliant

PERMITTED TRANSFER (Earnings → Spending): Creators may transfer funds from their Earnings Wallet to their Spending Wallet at any time. This allows creators to purchase content on the platform using their earned funds. Transfers are instant and irreversible.

PROHIBITED TRANSFER (Spending → Earnings): TRANSFERS FROM SPENDING WALLET TO EARNINGS WALLET ARE STRICTLY PROHIBITED. Deposits made to the Spending Wallet are for purchasing content only and cannot be converted to withdrawable earnings. Any attempt to reverse, circumvent, or bypass this restriction constitutes a violation of these Terms and will result in immediate account termination and reporting to relevant authorities.

Why This Policy Exists (Legal & Regulatory Compliance):

  • 🛡️ PREVENTS MONEY LAUNDERING: Prohibits criminals from depositing illicit funds and withdrawing "clean" money
  • 🛡️ PREVENTS CHARGEBACK FRAUD: Prevents users from depositing with stolen credit cards and withdrawing cash
  • 🛡️ PREVENTS CIRCULAR TRANSACTIONS: Prevents users from "buying" their own content to artificially inflate earnings
  • 🛡️ COMPLIES WITH FINANCIAL REGULATIONS: Meets AML/KYC requirements for money service businesses
  • 🛡️ PROTECTS PLATFORM INTEGRITY: Ensures legitimate earnings are properly tracked and verified
  • 🛡️ FATF COMPLIANCE: Aligns with Financial Action Task Force recommendations on virtual assets

Exception: Refunds approved by our support team under Section 7.4 may credit funds back to the original wallet type used for payment. Crypto refunds are sent back to the original wallet address.

🔒 6.4 Anti-Money Laundering (AML) & Fraud Prevention

BY USING THIS PLATFORM, YOU EXPLICITLY ACKNOWLEDGE AND AGREE TO THE FOLLOWING AML PROVISIONS:

Suspicious Activity Monitoring: We employ automated and manual monitoring systems to detect suspicious activity, including but not limited to:

  • Large or unusual deposit patterns
  • Circular transactions (deposit → purchase from own account → withdraw)
  • Multiple accounts linked to the same individual
  • Rapid deposits followed by immediate withdrawal requests
  • Transactions involving known fraud indicators
  • Patterns indicative of money laundering or terrorist financing

CONSEQUENCES OF SUSPICIOUS ACTIVITY: If we reasonably suspect money laundering, fraud, or any violation of these Terms, we may:

  • Immediately freeze your account and all funds
  • Suspend withdrawals pending investigation
  • Report suspicious activity to relevant financial authorities
  • Permanently terminate your account without refund
  • Cooperate fully with law enforcement investigations
  • Hold earnings for up to 90 days pending investigation

7. Payments & Subscriptions

7.1 Payment Methods Crypto Supported

We accept the following payment methods:

IMPORTANT: Cryptocurrency transactions are IRREVERSIBLE. There are NO chargebacks with crypto payments. By choosing to pay with cryptocurrency, you waive any right to dispute the transaction through your bank, credit card company, or payment processor.

How Crypto Payments Work:

  • ✅ Payment is confirmed on the blockchain (typically 10-60 seconds for TRC-20, 5-30 minutes for other networks)
  • ✅ Your subscription/access activates immediately upon confirmation
  • ✅ No chargebacks possible - transactions are final
  • ✅ Lower transaction fees compared to cards (typically $0.50-$1 for TRC-20)
  • ⚡ Recommended: USDT on TRC-20 network (fastest, lowest fees)

USER RESPONSIBILITY FOR CRYPTO ERRORS: You are solely responsible for:

  • ✅ Double-checking wallet addresses before sending cryptocurrency
  • ✅ Ensuring you select the correct network (TRC-20, ERC-20, BEP-20, etc.)
  • ✅ Understanding fees charged by your exchange or wallet provider
  • ✅ Keeping records of your transactions (TXIDs, receipts, confirmations)
  • ✅ Providing the correct Transaction ID (TXID) - incorrect TXIDs delay verification

WE ARE NOT RESPONSIBLE FOR: Funds sent to incorrect wallet addresses, funds sent on incorrect networks, delays caused by third-party platforms, network congestion, or any losses incurred due to user error.

Cryptocurrency Refunds (if approved under Section 7.4):

  • 💰 Refunds are processed in the SAME cryptocurrency used for payment
  • 💸 Funds are sent BACK to your original crypto wallet address
  • 📊 Exchange rate: Refund uses current market rate at time of processing (not original purchase rate)
  • ⏰ Processing: 1-2 hours after approval (depends on blockchain network)
  • 🔒 Platform fee is NOT refundable (covers network and processing costs)
  • ⚡ Network gas fees are paid by the recipient

No Chargebacks: Because crypto transactions are irreversible, you cannot file a chargeback with your crypto provider. All sales are final per our refund policy below.

7.3 Subscriptions

Subscriptions provide unlimited access to all premium content on the Platform. Key features:

Refund Window: Requests accepted within 1 day(s) of payment (24 hours). Requests submitted after this window will be automatically denied.

We DO NOT offer refunds for:

  • ❌ Accidental purchases (you confirmed the transaction)
  • ❌ Subscription cancellations (you retain access until end of billing period)
  • ❌ Not using the Platform or your subscription
  • ❌ Technical issues due to your internet connection, device, or browser
  • ❌ Content that was watched more than 10%
  • ❌ User error when sending cryptocurrency (incorrect address, wrong network)
  • ❌ Price fluctuations or dissatisfaction with value received
  • ❌ Account suspension or termination due to Terms violation

Limited exceptions at our SOLE DISCRETION:

  • ⚠️ Verified technical issues preventing content access (after troubleshooting with support)
  • ⚠️ Content that was materially misrepresented in the listing (fraudulent description)
  • ⚠️ Duplicate charge due to system error (not user error)
  • ⚠️ Unauthorized charges after you reported your account compromised (with proof)

Approval of refunds is NEVER guaranteed and is determined on a case-by-case basis at our sole discretion.

Refund Processing (If Approved):

  • 💳 Credit/Debit Card payments: Refund credited to your Spending Wallet as store credit (not back to card)
  • ₿ Cryptocurrency payments: Refund sent BACK to your original crypto wallet address in the SAME cryptocurrency
  • 🔄 Wallet balance purchases: Refund credited back to your Spending Wallet
  • 💰 Approved refunds are deducted from the creator's Earnings Wallet (chargeback)
  • ⏰ Refunds are typically processed within 3-7 business days after approval
  • 📧 You will receive email and dashboard notification when processed
  • 🔒 Platform fees, network fees, and processing fees are NON-REFUNDABLE

How to request a refund:

  2. For content refunds, contact support via Contact Us
  3. Provide your transaction ID, purchase date, and reason for refund
  4. Our team will review within 24-48 hours

⚠️ CHARGEBACK FRAUD WARNING: Filing a fraudulent chargeback with your bank or payment provider is a violation of these Terms and may result in:

  • Immediate account termination
  • Permanent ban from the Platform
  • Reporting to fraud databases (Kount, Riskified, Sift)
  • Legal action to recover damages (including legal fees and chargeback fees of $15-50 per incident)
  • Reporting to credit bureaus
  • Criminal prosecution for fraud in applicable jurisdictions

Our escrow service facilitates safe physical meetings between users:

  4. ✅ Both parties confirm meeting completion and safety
  5. 💵 Funds released to creator's Earnings Wallet after mutual confirmation

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL DesirexFans BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your use or inability to use the Platform
  • Any conduct or content of any third party on the Platform
  • Unauthorized access, use, or alteration of your transmissions or content
  • Errors in cryptocurrency transactions (incorrect addresses, wrong networks)
  • Third-party exchange or payment processor failures
  • Blockchain network congestion or failures
  • Any other matter relating to the Platform

OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO THE PLATFORM IN THE PRECEDING 12 MONTHS, OR $100, WHICHEVER IS LESS.

You agree to indemnify and hold harmless DesirexFans and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Platform or violation of these Terms, including but not limited to:

16. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Nigeria, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or your use of the Platform shall be submitted to the exclusive jurisdiction of the courts located in Nigeria. You agree to waive any objection to such jurisdiction and venue.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

18. No Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision. Any waiver of any provision of these Terms must be in writing and signed by an authorized representative of DesirexFans.

19. Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and DesirexFans regarding your use of the Platform.
